Twitter’s Tweets Can Create Legal Issues

lawglobeThe 140 characters or less answer to the question, “What are you doing now? has the potential to create a litigation minefield for attorneys, their employers and  other businesses states Marthat Neil in the May 15, 2009  ABA Bar Journal.

Accordingly , lawyers and professional employees must   be careful  not to convey proprietary information or reveal privileged or private information  which could potentially expose the company to  a lawsuit.

Twitter “tweets”  are so new that the best practices for addressing the social networking phenomenon are still being developed. Therefore, attorneys should be wary of  providing confidential information that  could be considered solicitations for clients. Furthermore, on the corporate side employers should establish standards for business related Tweets.

Yes, lawyers of all makes are beginning to engage in this fast g rowing social network. Jim Calloway, a Oklahoma legal technology guru , explains how Twitter is not just a passing fad and that lawyers need to be aware of the legal implications of  Twitter or any social media. This social media will have an impact on a lawyer’s practice because  of  a “business client who wants to discuss a policy on employees using social media at work or a family law client who believes that there is valuable evidence lurking in Twitter posts”, expounds Calloway. Therefore, remember “tweets” can become valuable evidence.

Some  cautionary advice that Calloway (@jimcalloway) provides is :

1.  Be careful about overuse of Twitter. You don’t want your followers and clients to believe you have nothing else to do.

2. If you ‘re using Twitter for practice development, watch how often you stray  from your  primary topic. Keep some professional distance in the attorney-client relationship.

3. Don’t expect that your tweets are to be kept private.

Now I don’t “tweet”. However, I believe that those who engage in this practice in their business should proceed with caution. The chatter about Twitter in the legal profession is growing.

The Chatter About Twitter in the Legal Profession

legal booksI must admit , as stated earlier in  a post in this blog , I have been  slow to engage in  social networking.  Not just slow,  but reluctant and I have not engaged in the process for many reasons. Although a professional, I didn’t get what the “craze ” was all about. I have received  email notices that  so and so would like for you to be their friend on Facebook, Linked-In and others  social networks . I have gone to the location and when I am asked to complete the information, I exit the site. It  was a challenge for me to start blogging until Pam Perry ,the Christian Marketing guru ( pamperry@ministrymarketingsolutions.com, http://www.ministrymarketingsolutions.com/blog)  challenged  the group attending the American Christians Writers meeting to set up a blog for a book review. ( read my April blog post). This blog is the result. I must admit earlier this year my attitude was why blog?

I indicated in my last blog that I had no interest at all in Twitter.  However,while reviewing the American Bar Journal (ABA)I begin seeing articles on the impact of  social networking on the legal profession. I was curious to know  why an attorney would be interested in Twitter.  

                                                          lawglobe Interest in Twitter in the legal profession is increasing  as having business value. In the article in the ABA Journal, April 2009,entitled “Much Chatter About Twitter” by Barbara Rose, it discusses the influence of Twitter in the legal profession. The articles tells  how one young attorney started following a local mover and shaker with interests  that matched his own. Within four months  “of gathering in real space of people connected through Twitter” the attorney picked up four new clients. The young  attorney stated that one uses this tool to “seek out a community you know would be beneficial to you”.

However, the article in the bar journal contrasted this experience with another attorney who felt that Twitter was a distraction, a source of stress and did not help him build relationships because “the process depersonalized communication by speeding it up through group conversations”. The article quoted him as saying ” It just doesn’t provide the bang for the buck  that technology needs to deliever before I use it every day”.

Now its true that twittering lawyers are few in comparison to the number of users. But it is not  lost on the profession that Twitter or another similar technology  will have a “growing influence over buisness communication”. The Interent based service has estimated that of the “3 million users about 560 of them are lawyers and legal professionsals according to  a list by Adrian Lurssen on the JD Scoop blog at JDSupra.com” states the ABA article. The profession uses it as a marketing tool and others find it helpful to  getting questions answered and staying abreast of what is happening in the legal and technological world. Philadelphia courts post news and announcements.

While this is seen as a great new social networking tool,  there is no doubt that a Twitter message will be involved in litigation . These messages can leave digital traces that are subject to discovery if a legal dispute arises, just like e-mail and text messaging as we have seen in the city of Detroit involving the former mayor.

More lawyers are recognizing that  Twitter has potential for  building their practices . Some even find that its fun and interesting . One Philadelphia based tax attorney, Kelly Phillips Erb, blogs at taxgirl.com and tweets about her life as a mom as well as her law practice. Another chief executive in Seattle, who is a social media expert for a law firm marketing, initally thought that Twitter, as I do , was  a silly thing . However, he began to use it to pass along useful links and to post interesting “tweets”. To his surprise the number following him grew from 300 to more than 1,500. He realized he could not have developed that big of a following in a matter of weeks even if he had hired a top public relations firm. Now Kevin O’Keefe ,chief executive of LexBlog Inc, the article reports, tweets about 40 times a day. 

Yes, there is much chatter about Twitter ,that I will share in the future, but I still have yet to try  to engage in this form of social networking. Pam Perry  will have to find some engaging method to push me to do so.

“Transform Your Thinking”-Adventures Creating a Blog by Fegins (Faygo)

Completing my first blog on April 29, 2009,  to meet the  April 30th deadline  to post a book review on visionary pastor, Dr. Bill Winston’s book “Transform Your Thinking, Transform Your Life” was a challenge for me. You see I am not very computer savvy. I am the last one at work who wanted to use the computer and was happy to learn to answer emails and to learn how to attach a document to an email.  Wow. Beyond that well…    I was satisfied with that. Many fantastic attributes of the computer and what it could do was of no interest to me or I was frustrated at attempting to learn how to make the steps. My secretary is precious to me , so while others used their computers to pump out legal work etc, not me.  I turned all assignments in by hand.  Email,  articles on the Internet, type a  few notes I did.  However, at home I did  write some articles , notes for my book on the computer , my Sunday School Lesson plan and others. I just did the ordinary basics.

When American Christian Writer President , Pam Perry ,challenged us to do a book review on one of two books on a blog, I thought blog who wants to do that? ( pamperry@ministrymarketingsolutions.com,)    I  needed to renew my mind about blogging because I would not even read blogs except that of  the great Christian PR marketing coach Pam Perry’s.   To tell the truth I never thought it was a blog -it was so power packed with great articles, PR nuggets and etc. It was  informative ,attractive,and inspirational. However, I never understood all the side bars or used them. I signed up and decided to take the challenge and was assigned Bill Winston’s book about transforming your thinking. How ironic.  

I needed to  change the way I thought about blogging, twittering , face book etc. It was easier said than done for me. Pam conducted a teleseminar and  entrepreneur and “techie” guy  Ralph Claxton. joined us. I heard them on the line, took notes, but I was still lost and could not keep us with the easy steps Ralph told them about. So when Ralph rc@learnaniche.com   told us about his WordPress Blogging School and the discount he was offering I decided to take the course. Ralph was very helpful and his seven video course interesting.  Ralph went beyond the call of duty to help me set up a new computer, purchase a domain and to select a host. Of course I selected Ralph’s business(nichebloghost.com) as a host.  He responded with patience to my emails and calls. Thanks Ralph. However, every step on the video was still a challenge to me. I still have not used my new blog  which he hosts under my new domain  name because I had a few challenges applying the necessary steps.  (That is due to my slowness and not the class) One night I tried for hours to get through the blog process to no avail.

Desperate ,I emailed Shekini Jennnings ,  hhtp://shekinijennings.wordpress.com/ . I have never met this kind woman ,but she helped me to apply a picture and to get through the process. Thank you. Just to show how challenging it was ,even after she helped me ,my picture did not post and the blog was terrible.  The next day she  called and walked me through it again ( I was too embarrassed to call her because I did not want to unduly bother her so it was a blessing when she called to check on me).  When it posted I was excited.

On Wednesday April 29th I was on the “New Voice” blogtalk radio show  www.blogtalkradio.com/the-new-voice ,
with the visionary and international missionary and entrepreneur Minetta Hare talking about prayer.  I will be on blog talk radio for the next 8 weeks. I am slowly  getting it Pam , Ralph, and Minetta of the ministry and business benefits of  the Internet and the various avenues one has to be a blessing in the kingdom and to grow his or her business. So therefore my new blog and domain name  ,the-lady-of-prayer.com , which Ralph helped me to set up,will be useful.  I will make an effort to continue to renew my mind  about blogging  and get out of my comfort zone as Bill  Winston’s book challenged. Now I guess I will see what twittering is all about, maybe. Last month I had no interest. Blogging is enough hard work for me.

Linda’s Review of “Transform Your Thinking, Transform Your Life” by Bill Winston

 

 

 

The election of President Obama put a new charge of hope in the atmosphere. For many his election resurrected hope and faith in America and in mankind . Young and old saw his election as the inspiration to raise the bar of believing that one can achieve whatever he or she puts in his mind and heart. The theme “Yes we can”  encouraged people to believe that barriers people once thought to be  insurmountable can be overcome. How inspirational. However,I wonder for how long will this enthusiasm raise the level of our hopes and thinking last?  Don’t get be wrong, I think its wonderful and I am riding on the wave as well. But to accomplish all that this election represents and what God’s wants to do for His kingdom  we must truly have renewed hearts and minds.  While all this is wonderful and heartfelt we need to have a real change in our attitude and mindset for us to consistently live on a higher level and to truly embrace a higher level of living and thinking that will effectuate real change.

The book “Transform Your Thinking, Transform Your Life “by Dr. Bill Winston offers practical and bible based ways in which you and I can change our thought patterns which in turn will change your world and destiny by the renewing of our mind. We all want change in our lives that leads to the abundant life.The way to do that is to first change the way you think. The book also provides  realistic examples of  how to make and carry out the decision to renew your mind.

Dr Winston lets us know that you have to make a choice to renew your mind and ways of thinking. Your soul is your mind, emotions and will and where youmake decisions. The bible emphasizes, as Dr Winston points out, that you must have your mind transformed by the Word of God which means “it must come under the complete submission of the Holy Spirit in your spirit”. It sounds “deep” ,but Dr Winston provides  bible based characters and real life examples  of how you can and must accomplish the process of transforming your thinking if you want to change your life from the inside.

God has a potent supernatural remedy for defective, low expectations ,low living and it is His Word. God’s plan for your destiny is very different from the world’s which can bring a number of fiery trials such as discouragement and pressures on every side. How can  you elevate your thinking to a  higher standard of living? Dr Winston tell us that we have to change our thought patterns and processes which follow the world and meditate on the Word . Dr Winston lets us know we must leave our comfort zones, stop being stuck in the miry clay of “stinking thinking” or thinking as we always have , and meditate on the Word until we can believe what God tells us about the circumstances. You cannot go where you can not see or believe he explains. The book challenges one to learn to think right . In order to do so you have to go through a spiritual renovation and to change what Dr .Wilson calls  our “set point” wherein we have a certain thought process that we are “stuck in”.

I was blessed by the book . Last  Saturday I visited the “Artistry of Hair” salon and the women begin talking about choices they had made or need to make in their  lives. I had the book with me  and shared  certain chapters from the book. One patron asked the question” how do you know that God told you something and it appears that in the natural nothing is happening?

Well I read from the book Dr.Winston’s experience in 1997. That year he formed  the Forest Park Plaza  Inc, to acquire a mall. He learned how the inheritance God has for you can be beyond your ability to conceive or obtain. He explained how God told him to start the undertaking and he took steps of faith to do so. However ,the funding dried up and it looked like the  organization would be unable to acquire the mall. He had to get back in the Word and meditate on it until “his ability to believe was up to the challenge in front of me.” God confirmed  that he did indeed give Dr. Winston the vision for the mall. So another lesson Dr Winston teaches us is that “Meditating God’s Word turns pressure into prosperity”. The book provides spiritual nuggets and strategies that will help you to consistently think about your purpose , develop the courage to step out of your comfort zone and into the great things God has in store for you  and ,will  stretch you to renew your mind  to overcome adversity and your current circumstances.
